Terms of service

The terms of using the KmFlow service. In effect from 5 November 2026. This is a translation; the Hungarian version prevails.

1. The provider

2. The service

KmFlow is an online trip log and waybill service, available at app.kmflow.cloud. From the data of a GPS device fitted in the vehicle it suggests trips, which the user approves or corrects; trips, refuels and odometer readings can also be recorded by hand; closing a month produces a printable trip log and waybill in PDF. The app and kmflow.cloud show what the service currently includes. KmFlow is under development: its features may grow and change.

3. Who it is for

KmFlow is for businesses: sole traders, companies and other organisations, for their business or professional activity. You cannot sign up as a consumer. Whoever completes the sign-up declares that they may act on behalf of the business given. The contracting party is the business (hereinafter: the Customer); the person signing up is the first owner of its account.

4. Conclusion of the contract

The contract is concluded when the sign-up is confirmed: after sending the form you open the link in the confirmation e-mail and confirm. You can correct the form's data at any time before sending it, and change it in the account afterwards.

The contract is concluded electronically, in Hungarian. It is not a written contract and is not filed; these terms are always available at this address. The time of acceptance is recorded with the account.

5. Free trial and fees

KmFlow is currently available as a free trial. The trial lasts until paid plans are introduced.

At least 30 days before paid plans are introduced, we tell you the prices and terms by e-mail.
You pay only if you expressly choose a paid plan: the trial does not turn into a paid subscription by itself.
If you choose no plan by the end of the trial, your account stays read-only for another 30 days, during which you can download all data; then we delete the account and the data.

6. Account, members and permissions

The account owner can invite further members with a role (owner, driver, accountant, viewer). The Customer is responsible for whom it invites and for what its members do in the account. Sign-in details must be kept confidential; we recommend turning on two-factor authentication. If you suspect misuse of the account, write to us at once. On suspected misuse we may suspend access temporarily.

7. The Customer's responsibility

The Customer is responsible for the accuracy and completeness of the data recorded and approved. The trip log and the waybill are the Customer's records: checking and signing them before use is the Customer's task.
KmFlow is a tool, not tax or legal advice. Whether the records suit the Customer's tax situation is for the Customer to decide, with its accountant or tax adviser where needed. We are not liable for consequences imposed by an authority that arise from data the Customer entered or approved.
Obtaining and fitting the GPS device and its mobile subscription are the Customer's task.
If the GPS device works in a vehicle used by employees or other people, the Customer is responsible for informing them in advance and for having a legal basis for processing the location data (for example under section 11/A of the Hungarian Labour Code).

8. Prohibited use

It is prohibited to use the service for unlawful purposes; to upload other people's data without a legal basis; to test, bypass or overload the system's security; to pass on or resell access to third parties; and to reverse-engineer the software where the law does not allow it. On prohibited use we may suspend access and, in serious cases, terminate the contract at once.

9. Availability and support

We aim to keep the service available at all times, but during the free trial we do not commit to any availability. We announce planned maintenance in advance where possible. The data is backed up daily. For questions or problems we help at hello@webshopbirodalom.hu.

10. Intellectual property

KmFlow's software, design and name belong to the Provider. For the term of the contract the Customer receives a non-exclusive, non-transferable right to use the service. The Customer's data remains the Customer's; we use it only to provide the service.

11. Data protection and processing

How account, sign-in and security data is handled is set out in the privacy notice. For the trip log data the Customer is the controller and we are the processor; under Article 28 of the GDPR the following applies.

Subject, duration: providing the KmFlow service, for the term of the contract
Nature and purpose: storing, organising and processing the data (splitting trips, looking up addresses, calculating distances), producing documents, showing them to the Customer's authorised members
Data subjects: the Customer's members and drivers, the users of the vehicles, the contacts of the Customer's partners
Data: name, e-mail address, vehicle details, the GPS device's identifier and location data, trips (time, address, distance, purpose, partner), refuels, odometer readings, partner details, the change log

As processor we undertake to:

process the data only on the Customer's instructions; using the service and these terms count as the instructions;
bind those with access to the data to confidentiality;
protect the data with appropriate technical and organisational measures (as set out in the privacy notice);
use further processors only from those listed in the privacy notice; announce a new one at least 15 days in advance, when the Customer may object or terminate;
help with data subject requests and, where needed, with a data protection impact assessment;
notify the Customer of a personal data breach without undue delay, within 48 hours at the latest;
let the Customer download its data before the contract ends; delete it within 30 days after the end, after which it leaves the backups within 6 months;
provide on request the information that shows these obligations are met.

The trip log data is in Hungary, on our own server and backup storage.

12. Liability

To the fullest extent permitted by law, we are not liable for indirect damage, lost profit, or damage arising from incorrect data given by the Customer, from a fault of the GPS device or the mobile network, or from an outage of a third party's service. During the free trial the service is provided as it is at the time. This does not limit liability for damage caused intentionally or by gross negligence, or for a breach of contract that harms human life, physical integrity or health.

13. Termination

The Customer may terminate the contract at any time: it can ask for the account to be deleted at hello@webshopbirodalom.hu, until the app has a button for it. We may terminate with 30 days' notice by e-mail, and at once on prohibited use. Before the end the data can be downloaded (monthly PDFs, the log export); we delete it within 30 days after the end.

14. Changes to the terms

If these terms change, we tell you by e-mail or in the app at least 15 days before the change takes effect. If you do not accept the change, you may terminate the contract until it takes effect; using the service afterwards counts as acceptance.

15. Complaints and contact

Send questions and complaints to hello@webshopbirodalom.hu; we answer on the merits within 30 days.

16. Governing law and disputes

The contract is governed by Hungarian law, in particular the Hungarian Civil Code. We first try to settle a dispute by negotiation; failing that, the Hungarian court with jurisdiction and competence decides.
